**Terms and Conditions for Data Center Services - Dedicated Server and Colocation**
These Terms and Conditions ("Agreement") govern the use of dedicated server and colocation services ("Services") provided by Wolast Technologies hereinafter referred to as "Provider." By accessing and utilizing the Services, you ("User") agree to abide by these terms.
**1. Service Usage:**
1.1 User agrees to use the Services in compliance with all applicable laws and regulations.
1.2 User is responsible for maintaining the confidentiality of access credentials and for any actions performed under their account.
1.3 User shall not engage in any activity that compromises the security, integrity, or availability of the Services, including but not limited to hacking, spreading malware, or unauthorized access.
**2. Dedicated Server Services:**
2.1 Provider shall provide User with the specified dedicated server resources as outlined in the selected service plan.
2.2 User is responsible for the management and maintenance of their dedicated server, including software installations, updates, and security.
**3. Colocation Services:**
3.1 User shall be allocated physical space within Provider's data center facility for the placement of User-owned equipment.
3.2 User is responsible for the setup, configuration, and maintenance of their own equipment.
**4. Billing Terms:**
4.1 User agrees to pay all applicable fees and charges as outlined in the selected service plan and pricing schedule.
4.2 Payments shall be made according to the chosen billing cycle (monthly, quarterly, annually) and are due in advance.
4.3 Failure to pay fees may result in suspension or termination of Services.
4.4 All fees are non-refundable unless explicitly stated otherwise.
**5. Abuse Terms:**
5.1 User shall not engage in any activity that could result in harm to Provider's network, infrastructure, or other users. This includes, but is not limited to, Distributed Denial of Service (DDoS) attacks, spamming, and illegal content distribution.
5.2 Provider reserves the right to suspend or terminate Services without notice if abusive behavior is detected.
**6. Termination:**
6.1 Either party may terminate this Agreement with written notice in case of a material breach by the other party.
6.2 Upon termination, User shall immediately cease all use of the Services and remove their equipment (in the case of colocation).
**7. Limitation of Liability:**
7.1 Provider shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use or inability to use the Services.
7.2 Provider's total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by User for the Services in the three (3) months preceding the event giving rise to the claim.
**8. Amendments:**
8.1 Provider reserves the right to modify these Terms and Conditions, including pricing, at any time. Changes shall be effective upon posting on Provider's website.
**9. National ID Card Submission and User Information:**
9.1 User shall be required to submit a copy of their valid National ID card or government-issued identification for security verification purposes during the account setup process.
9.2 Provider shall securely store this information and reserves the right to share user details, including the National ID card copy, with law enforcement agencies in the event of suspected illegal activities, as required by applicable laws.
9.3 User agrees to promptly update their contact and identification information in case of any changes.
**10. Colocation Payment Terms:**
10.1 For colocation services, User agrees to pay the prepaid bill for the upcoming billing period within seven (7) days of receiving the invoice.
10.2 Failure to make payment within the specified time frame may result in suspension or termination of colocation services.
10.3 Reinstatement of colocation services after suspension due to non-payment may be subject to additional fees.
These additional sections shall be considered integral parts of the existing Terms and Conditions outlined earlier. By continuing to use the Services, User acknowledges and agrees to the provisions specified in these new sections.
